CDPAP Rules and Regulations

The following are CDPAP rules and regulations that commonly apply.

  • CDPAP is a Medicaid-based program, and applicants must be enrolled in Medicaid to participate.
  • All consumers must require home care services.
  • Consumers must be capable of self-directing or have a designated representative to direct their care.
  • Under CDPAP, consumers may employ almost anyone who is legally permitted to work as their paid caregiver, including the majority of family members and friends.
  • It is permissible for parents to hire their offspring to serve as their paid family caregivers.
  • Children aged 21 or older are allowed to select their parents as their paid caregivers. However, children under the age of 21 cannot employ their parents for paid caregiving services.
  • Siblings are eligible to be chosen as paid family caregivers by CDPAP home care consumers.
  • Spouses are not permitted to hire one another as their paid family caregiver.
  • There is no requirement for caregivers to possess any specific license or certification.
  • Training of the caregiver is the responsibility of the consumer or their representative.
  • Unlike conventional home health aides, CDPAP caregivers are authorized to perform skilled services such as wound care, administering insulin injections, and suctioning tracheostomies.
